PERSONAL INFORMATION COLLECTION STATEMENT 


PCGC Limited (the "Company", "we", "us" or "our") is a company incorporated under the laws of Hong Kong with its registered office at Room 801, 8/F, Far East Consortium Building, 121 Des Voeux Road Central, Hong Kong. This personal information collection statement ("PICS") sets out the purposes for which your Personal Data1 may be collected, used, processed, disclosed, transferred and retained by us in relation to your registration of interest in subscription of Debentures ("Debentures") for financing the development of the proposed Plover Cove Golf Club ("Debenture Programme"). 
 

1. Collection of Personal Data 

1.1 In order for us to contact you regarding your interest in the Debenture Programme (including processing your subscription application and sending your more information), you will need to provide us with the following categories of Personal Data that we have indicated as being mandatory for you to provide:
 
  1. Your name;  
  2. Contact details; 
  3. Address; 
  4. DOB; 
  5. Identification Number; 
  6. Employment details; 
  7. Business Details (Corporate Applicants only); and 
  8. Name of Referrer  
If you do not provide such mandatory information, or if any information you provide is untrue, inaccurate or incomplete, we may not be able to contact you about the Debenture Programme. All other information you provide is voluntary. 

1.2 If you provide us with the Personal Data of another individual in connection with the Debenture Programme, you confirm that you have obtained the consent of the relevant individual to provide their Personal Data to us, and for their Personal Data to be used, processed, disclosed, transferred and retained by us in accordance with this PICS.
 

2. Use of Personal Data

2.1 We may use the Personal Data you provide for the following purposes: 
 
  1. to administer and provide the Debentures; 
  2. to process, handle or communicate with you in respect of any enquiry, complaint or service support request relating to the Debenture Programme; 
  3. to improve our operations through various means, such as the use of analytics tools, research, surveys and feedback forms;  
  4. to investigate or handle any incidents, claims or disputes, defend or bring any claims or actions, or comply with any applicable laws or any requests from any regulatory authority, court or government authority; 
  5. subject to your consent, to provide you with marketing and promotional materials in connection with the latest news, events, updates, offers, contests and promotions relating to the Debenture Programme; 
  6. subject to your consent, to allow our affiliates and/or partners to provide you with marketing and promotional materials in connection with the latest news, events, updates, offers, contests and promotions relating to their own goods and/or services. 
 

3. Disclosure and transfer of Personal Data 

3.1 To fulfill any of the above purposes, we may transfer your Personal Data to the following parties, whether inside or outside of Hong Kong:
 
  1. our affiliates2;  
  2. service providers;  
  3. professional advisors;  
  4. our legal and professional advisors; and 
  5. any government or regulatory authorities or third parties in accordance with any legal or regulatory requirements or any court order applicable to us. 
3.2 We may also share your Personal Data with any third party in connection with a merger, acquisition, consolidation, restructuring, sale of assets, financing or any similar scenarios.   

 

4. Access to and correction of your Personal Data

4.1 You have the right to request access to and correction of your Personal Data held by us, by submitting a written request to our Admin Officer who will be in-charge of receiving and processing such requests at Room 1101, 11/F., Far East Consortium Building, No.121 Des Voeux Road Central, Hong Kong. 
 

 

5. Direct Marketing

By clicking the "submit" button below and submitting the registration of interest form to us, you indicate your agreement to the use of your name, phone number, email, address and business details to send you direct marketing materials in accordance with this PICS.

  1. Any information (directly or indirectly) relating to an individual, from which such individual can be identified, or where an individual is identifiable.  
  2. Any entity directly or indirectly controlling or controlled by or in common control with us, where "control" is defined in this context as the power (whether directly or indirectly, including through any nominee(s)) to direct or cause the direction of our management and policies, whether through the ownership of voting shares, securities, by contract, or otherwise, including through any direct or indirect ownership of more than 50% in our voting securities or an interest in our assets, profits, or earnings.

PCGC Limited（「本公司」、「我们」或「我们的」）是一间根据香港法律注册成立的公司，其注册办事处位于香港中环德辅道中121号远东发展大厦8楼801室。 本个人资料收集声明（「PICS」）载列了我们就您认购债券（「债券」）的意向登记表可能收集、使用、处理、披露、转移及保留您的个人资料的目的，债券旨在为发展提议的船湾高尔夫球会提供融资（「债券计划」）。 
 

1.个人资料的收集 

 
1.1为了方便我们就您加入债券计划的意向与您联络（包括受理您的认购申请及向您发送详情），您将需要向我们提供以下类别的个人资料（这是我们已指明您需要提供的强制性资料）： 
  1. 您的姓名; 
  2. 联络电话; 及 
  3. 电邮地址 
  4. 推荐人姓名。 
若您不提供有关强制性数据，或者您提供的任何数据不真实、不准确或不完整，我们可能无法就债券计划与您联络。 您自愿提供所有其他资料。 
 
1.2若您就债券计划向我们提供其他个人的个人资料，您确认您已获得相关个人的同意，以向我们提供其个人资料，并同意我们根据本PICS使用、处理、披露、转移及保留其个人资料。 
 
 

2.个人资料的使用 

 
2.1 我们可能将您提供的个人数据用于以下目的： 
 
  1. 管理及提供债券； 
  2. 受理、处理或与您沟通与债券计划有关的任何查询、投诉或服务支持申请; 
  3. 通过多种途径改进我们的运营，例如使用分析工具、研究、调查及反馈表; 
  4. 调查或处理任何事件、申索或争议、抗辩或提起任何申索或诉讼，或遵守任何适用的法律或任何监管当局、法院或政府当局的任何要求; 
  5. 在征得您同意后，向您提供涉及债券计划的最新新闻、活动、更新、优惠、竞逐及促销相关的营销与宣传材料; 
  6. 在征得您同意后，允许我们的关联公司及/或合作伙伴向您提供涉及他们自身的商品及/或服务的最新新闻、活动、更新、优惠、竞逐及促销相关的营销与宣传材料; 
 

3.个人资料的披露及转移 

 
3.1为实现上述任何目的，我们可能将您的个人数据转移至下列各方（不论在香港境内或境外）： 
  1. 我们的关联公司^; 
  2. 服务供应商; 
  3. 专业顾问; 
  4. 我们的法律及专业顾问; 及 
  5. 任何政府或监管当局或第三方（根据对我们适用的任何法律或监管规定或任何法院命令）。 

3.2 就合并、收购、整合、重组、资产出售、融资或任何类似情境而言，我们亦可能与任何第三方分享您的个人资料。 
 
 

4.查阅及纠正您的个人资料 

 
4.1您有权申请查阅及纠正我们持有的您的个人资料，方式是向我们负责接收及受理有关申请的行政人员提交书面申请，地址为香港中环德辅道中121号远东发展大厦11楼1101室。 
 
 

5.直接营销 

向我们提交意向登记表，即表示您同意我们使用您的姓名、电邮、及电话号码，根据本PICS向您发送直接营销材料。 
 
 
  1. 任何与个人（直接或间接）有关的资料，从中可以识别个人的身份，或使个人的身份可识别。
  2. 任何直接或间接控制我们，或受我们控制，或与我们共同受控制的实体，于本文意中，「控制」是指（不论直接或间接，包括透过任何被指定人）拥有权力来指导或安排指导我们的管理及政策，不论是透过有投票权股份、证券的所有权、透过合约或其他方式，包括透过直接或间接拥有我们50%以上的有投票权证券，或于我们的资产、利润或盈利中拥有权益。
